These Terms and Conditions of Sale ("Terms") apply to all sales transactions conducted through our website, https://thatsfurniture.com.au (the "Website"), and govern the sale of products and services offered by That's Furniture and Bedding, ABN: 87 309 597 660 ("we," "us," "our," or the "Company"). By placing an order with us, you agree to be bound by these Terms.

Please read these Terms carefully before making a purchase. If you do not agree with any part of these Terms, you should not proceed with your purchase. We reserve the right to update or modify these Terms at any time without prior notice, and such changes will be effective immediately upon posting on the Website. It is your responsibility to review these Terms periodically to ensure you are aware of any changes.

We recommend reviewing these Terms each time you visit the Website and before making a purchase. If we choose to notify you of any changes, you agree to receive such notifications via email.

Use of the Website

The Website may be accessed by guests or members. If you wish to become a member, please complete the registration form by providing your details. Your personal information will be handled in accordance with our Privacy Policy.

You must not use another member’s account without their permission. You are responsible for keeping your password secure, as you will be liable for any activity conducted under your account. If you become aware of any security breach or unauthorised use of your password or account, you agree to notify us immediately. If you forget your password, you may use the reset function on the Website or contact our customer service team for assistance.

We work with third-party service providers to help detect fraudulent activity on the Website. By accessing or using the Website, you acknowledge that your interactions with the Website may be monitored by us or third-party providers to identify potentially fraudulent transactions or misuse of the Website.

Refunds, Returns & Repairs

We accept returns and process refunds within 30 days of delivery, provided items are unused, in original packaging, and accompanied by proof of purchase. Non-returnable items include customized furniture, sale items, and gift cards.

For returns, please contact sales3@thatsfurniture.com.au with your order number and issue description. Return shipping costs are the customer’s responsibility. Refunds will be processed within 10 business days of return approval.

If you receive a damaged or defective item, contact us immediately for a repair, replacement, or return at no additional cost. For repair requests, contact us with issue details, and we'll provide repair options and potential costs if out of warranty.

Shipping & Delivery Policy

Delivery service

Available within a 150 km radius from our Marion Showroom (808 Marion Road, Marion, South Australia), covering areas from Barossa to Victor Harbour.

*Conditions Apply

We offer several delivery options and associated fees:

  • 1 Man - Free Delivery (If assisted to unload)
  • 2 Man - $80
  • VIP - $150
  • Stairs - $50

* VIP Service includes a two-person setup and removal of rubbish. Please note that flat pack furniture is excluded from this service. By signing, you acknowledge that delivery services are not liable for any accidental damage to the home.

We appreciate your patience and understanding regarding our delivery process. As a handcrafted industry, furniture production and delivery can sometimes experience unexpected delays.

Estimated Delivery Times

Our quoted delivery times are our best approximations and may occasionally vary due to factors outside our control. We'll keep you informed of any changes to your expected delivery date.

Delivery Considerations

To ensure a smooth delivery experience, please note:

  • Additional charges may apply for deliveries to locations with difficult access or installations involving stairs.
  • We kindly ask that you or a representative be present at the delivery address on the agreed-upon day. If we need to reschedule, a redelivery fee may be incurred.
  • We'll store your items for up to 14 days after notifying you they're ready. After this period, a storage fee will be applied.

Refunds Prior to Delivery

Should you need to cancel your order, a 20% fee of the total order value will be applied to cover our costs.

Repairs or Damages During Delivery

In the unlikely event that your items are damaged or needs repairs, being a local business its easy. All you need to do is just send a photo via our email address sales3@thatsfurniture.com.au and we can do a customer service report and rectify the issue promptly. Thats peace of mind from Thats Furniture.

$500 Mattress Trade-In Policy

The $500 Mattress Trade-In Policy is only available for major brands (please see in-store for details). This policy offers a convenient solution for disposing of unwanted mattresses while helping the environment and supporting employment opportunities for those in need.

Price Guarantee Policy

We offer a 14-day price match guarantee from the date of purchase. This policy requires proof of the competitor's pricing for the exact same product. The guarantee applies even if you picked up or had your item delivered on the same day.

Payment Options

We accept the following payment methods: Cash, Builders Lay-By (which requires a 20% deposit and an agreed-upon term, with the remaining balance to be paid in full once the lay-by term expires; we can hold the goods and deliver them upon property handover), EFTPOS, Visa, Mastercard, Humm, Latitude, and Afterpay.

Please note that cheques are not accepted on final delivery.

To ensure a smooth delivery or collection, please settle all balances before receiving your order. We value your business and look forward to helping you create your perfect living space with our quality furniture.

  • Public Holidays: 11:00 AM - 3:00 PM

Limitation of Liability

To the extent permitted by law, That’s Furniture and Bedding excludes all liability to you for any loss or damage related to the website, including but not limited to acting or failing to act based on information on our website or any linked website, personal injury or property damage resulting from your use of our website, and unauthorised access to or use of the website. Except as expressly stated in these Terms and to the fullest extent permitted by law, That’s Furniture and Bedding is not liable for any direct, indirect, special, incidental, or consequential damages arising from your use of the website. This clause does not exclude or limit any rights you may have under the Competition and Consumer Act 2010 (Cth). Please refer to our Refunds, Returns & Repairs Policy for more information.

Privacy and Personal Information

Our Privacy Policy, available [here], explains how we collect and manage your personal information in compliance with the Australian Privacy Principles under the Privacy Act 1988 (Cth).

Force Majeure

That’s Furniture and Bedding will not be liable for any delay in performing its obligations if caused by circumstances beyond our reasonable control, including but not limited to failures in essential services like electricity supply, bank payment systems, or postal deliveries.

Governing Law

These Terms are governed by and interpreted in accordance with the laws of South Australia, Australia. You irrevocably submit to the non-exclusive jurisdiction of the courts of South Australia.

Severability

If any part of these Terms is found to be void, invalid, unlawful, or unenforceable, that provision will be deemed severed from these Terms, and the remaining provisions will remain in force.

Transfer and Assignment

If That’s Furniture and Bedding merges, sells, or otherwise changes control of its business or website to a third party, we reserve the right to transfer or assign personal information, content, and agreements made with you in accordance with our Privacy Policy.

Waiver

Failure to enforce any right or provision under these Terms does not constitute a waiver. Any waiver must be in writing and signed by That’s Furniture and Bedding.
